§1 Privacy Policy
1.1 Data Controller. The data controller for all personal data collected through this website is PremiumDesignWorks, registered at 31290, 1 En Blanc, Mauremont, France. Contact: [email protected].
1.2 Data Collection. We collect personal data only when voluntarily submitted through our contact forms, including: full name, email address, phone number, company name, and project specifications. This data is collected solely for the purpose of responding to your inquiry and delivering requested services.
1.3 Legal Basis. Processing is conducted under Article 6(1)(b) of the GDPR — necessary for the performance of a contract or pre-contractual measures taken at your request. We also rely on Article 6(1)(f) — legitimate interest in responding to business inquiries.
1.4 Data Retention. Contact form submissions are retained for a maximum of 24 months from the date of submission. Project-related data is retained for the duration of the engagement plus 6 years for statutory tax and accounting obligations.
1.5 Third-Party Sharing. We do not sell, rent, or share personal data with unauthorized third parties. Data may be processed by our hosting provider (EU-based, ISO 27001 certified) and payment processor (Stripe, PCI-DSS Level 1 compliant) solely for service delivery purposes.
1.6 Your Rights. Under the GDPR, you have the right to access, rectify, erase, restrict processing, port, and object to the processing of your personal data. To exercise these rights, contact us at [email protected].
1.7 International Transfers. All personal data is stored within the European Economic Area (EEA). If any data transfer outside the EEA is required, we ensure adequate safeguards are in place via Standard Contractual Clauses (SCCs) as approved by the European Commission.
§2 Terms of Service
2.1 Scope of Agreement. These terms govern all services provided by PremiumDesignWorks to its clients. Engagement commences upon receipt of a signed Statement of Work (SOW) or written project confirmation via email.
2.2 Deliverables & Ownership. Upon full payment, all intellectual property rights, source code, design assets, and documentation produced specifically for the client are irrevocably transferred to the client. PremiumDesignWorks retains no rights to client-specific deliverables.
2.3 Payment Terms. Invoices are payable within 14 days of issuance unless otherwise agreed in writing. Late payments accrue interest at a rate of 1.5% per month. Projects exceeding €2,000 may require milestone-based payments as defined in the SOW.
2.4 Project Timeline. Estimated delivery timelines are provided in good faith and begin from the date of project kickoff (receipt of all required assets and information). Delays caused by the client in providing requested materials will result in proportional timeline extensions.
2.5 Limitation of Liability. PremiumDesignWorks' total liability under any engagement shall not exceed the total fees paid by the client for the specific project giving rise to the claim. We shall not be liable for indirect, incidental, or consequential damages.
2.6 Confidentiality. Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. This obligation survives termination of the agreement for a period of 3 years.
§4 Refund Policy
4.1 Eligibility. Refund requests are accepted within 14 days of payment if work has not yet commenced. Once development has begun, refunds are calculated proportionally based on the percentage of work completed as documented in the project timeline.
4.2 Milestone Payments. For projects structured with milestone payments, completed and approved milestones are non-refundable. Pending milestones may be cancelled with written notice at least 7 days before the scheduled milestone date.
4.3 Maintenance Retainers. Monthly retainer subscriptions may be cancelled with 30 days' written notice. No partial-month refunds are issued. Pre-paid annual retainers are refundable on a pro-rata basis minus a 10% administrative fee.
4.4 Dispute Resolution. Any disputes arising from refund requests shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the competent courts of Montpellier, France, in accordance with applicable French law.
4.5 Processing. Approved refunds are processed within 10 business days to the original payment method. Bank transfer refunds may take an additional 3–5 business days depending on the financial institution.
